Mr. John H. Daley
Jr., President of
Daley Corporation, San
Diego, was elected the 63rd President of the AGC San
Diego Chapter, Inc. during the Association’s Annual Meeting held
Wednesday, December 13th, 2007 at the Mission Bay Hilton
Hotel in San Diego. John succeeds
Tom Anderson,
Bergelectric Corporation,
as the Association’s President.
John was
elected AGC President by the 2008 AGC Board of Directors during a
meeting that took place immediately after the Annual Meeting. As
President, John will be responsible for providing leadership and
direction to the Association throughout 2008.
John has
served the AGC in a number of capacities during the past several
years. This past year he served as Chair of the AGC Government
Relations Committee and PAC. He headed up a very successful PAC
fundraising effort that raised $200,000 in 2007, and $119,500 in
pledges for 2008, for a total amount raised of
$319,500. He also served
as the AGC’s Builders’ Exchange Committee Chair, AGC Treasurer, and
AGC Membership Committee Chair. In addition, he has served as the
Chair of the AGC County Liaison Committee, and as an active member
of the Caltrans Liaison Committee and the City of San Diego Liaison
Committee. During 2007, he also served as a member of the special
task force that headed up AGC’s efforts concerning the California
Air Resources Board’s adoption of diesel emissions regulations for
the construction industry.
John’s
family has a long history with AGC San Diego. Daley Corporation
joined in 1927, the year the Association was formed. His great,
great uncle George Daley
was President in 1932 and 1933, his grandfather
Don Daley was AGC
President in 1959, 1972, and 1973, and his father
John Daley, Sr. was
President in 1990 and 1991.
The Board
also elected Mr. Kevin Elliott,
Roel Construction Co., Inc.
as the AGC Senior Vice President.
As Senior Vice President, Kevin will chair the AGC Government
Relations Committee and the PAC Committee.
Ms. Diane Keltner,
President of Synergy Electric Co.,
Inc. was elected the AGC Vice President. As Vice President, Diane
will be responsible for the Association’s membership recruitment
effort during 2008. Mr. Mark
Filanc, J.R. Filanc
Construction Co., Inc. was elected the Association’s
Treasurer. As Treasurer, Mark will be responsible for overseeing
AGC’s finances during 2008, and chairing the AGC Builders’ Exchange
Committee. Mark will also chair the AGC Water Authority Committee.

During the December 13th
Annual Meeting, AGC Executive Vice President Jim Ryan presented a
report to the membership detailing the Association’s past year.
Ryan praised the efforts of over 300 AGC Members that serve on AGC

During the
report, Greg Barnes,
Procopio, Cory Hargreaves &
Savitch, LLP and Education and Training Committee Chair
Byron Klemaske,
T.B. Penick & Sons, Inc.,
presented a check for $25,000 to San Diego’s Junior Achievement’s
BizTown as part of AGC’s $75,000 3-year commitment to the program.
AGC is the “construction company” in BizTown, which is a “village”
that teaches free enterprise to over 12,000 San Diego 5th
graders.
Jim Ryan
also reported that the AGC San Diego’s membership, including Plan
Room members, reached 1,316 during 2007. In 2000, AGC membership
was 310. 2006 membership was 1216. AGC finances were also
highlighted. It is anticipated that receipts will exceed
disbursements by over $300,000 during 2007. AGC’s income will be
just under $4,000,000 during 2007.
Federal Government Adopts New Ethics Rules for Contractors

On
November 23, the Federal Government finalized rules requiring most
federal contractors and subcontractors to adopt and promote a code
of business ethics, and to post a government provided hotline that
employees can use to report any wrongdoing. The new rules, which go
into effect December 24, would also require many federal contractors
and subcontractors to implement an ongoing
Business Ethics Awareness Program and an internal control system.
The new rule was
proposed in mid-February. AGC of America made several
recommendations, some of which were approved in the final
rulemaking, including the following:
·
Small businesses have been
exempted from the requirement to implement a formal training program
and internal control system.
·
Upon request of the contractor,
the contracting officer has been given authority to increase the 30
day time period for preparation of a code of business ethics and
conduct and the 90 day time period for establishment of an ethics
awareness and compliance program and internal control system.
·
A contractor will not be required
to display Government fraud hotline posters if it has established a
mechanism by which employees may report suspected instances of
improper conduct, and instructions that encourage employees to make
such reports.
Please note that while
the government did not agree to remove the subcontractor flow down
provision in its entirety, it is important to note two critical
changes:
·
The small business exemption does
indeed flow down to subcontractors.
·
A prime contractor “is not
required to judge or monitor the ethics awareness program and
internal control systems of the subcontractors – just check for the
existence.”

Second Proposal Issued
Not quite satisfied with
putting one ethics rule to bed, the government proposed a second and
much more prescriptive rule on November 14. In short, the proposal
would supplement much of the one just finalized. It would modify
the standards for debarment and suspension, and current notions of
“responsibility.” AGC plans to submit comprehensive comments on
this proposal.
City of San Diego’s Construction & Demolition Program - Keep an Eye
on New Surcharge!

It’s been
over two years since the adoption of the City of San Diego’s
Construction and Demolition (C&D) Debris Ordinance, which was passed
in order to divert more solid waste from landfills. The ordinance
had been “on hold” until a mixed-use recycling center was built
within the City. With the opening of the private SANCO (EDCO)
facility just outside the City limits, which can accommodate the
expected volume of mixed C&D to be generated within the City, and
two additional private facilities proposed to open in the near
future, there now is adequate infrastructure to support the C&D
Ordinance.
The C&D
Ordinance applies to private and City projects and features a system
of refundable deposits collected on building and demolition/removal
permits.
Key
Features of the C&D Debris Diversion Deposit Program include:
·
Deposit is based on square footage and type of project.
·
City will certify C&D recyclers, verifying diversion rate and
permit status.
·
To obtain refund in part or in full, the applicants must
document the following:
-
Debris is recycled with certified
facilities
-
On-site reuse of C&D debris
-
Other: Donations or reuse of
debris
Outreach
with stakeholders will occur early next year to help prepare for the
implementation of the C&D Ordinance and new City contract language
being developed by City staff.
C&D Surcharge
Contractors and
developers should be aware of a reactivation and increase of a C&D
surcharge at the Miramar Landfill,
currently effective on January 1, 2008. As approved, the surcharge
for flat rate loads is determined by multiplying the applicable
standard disposal fee for general refuse by 1.5. The surcharge for
weighted loads (fee based on actual weight) is determined by
multiplying the applicable standard disposal fee for general refuse
for weighed loads by 2.75.
The increased
construction and demolition surcharge will be imposed on all loads
which include 20% or more of C&D material delivered to the Miramar
Landfill for disposal.
Request to Change
Effective Date
On
Tuesday, the City Council will consider a change to the
implementation date of the surcharge to April 1, 2008. This change
will allow stakeholders (including contractors and developers) to
better plan their debris removal process and will allow them to
complete current projects without unforeseen costs. AGC will attend
the City Council meeting and will support the change from January 1
to April 1, 2008.
AGC and
its members are committed to help recycle or re-use C&D material,
and we strongly support efforts to divert more solid waste from
landfills. We look forward to working with City staff as this
ordinance is implemented, and we will assist in educational efforts
and will provide training, if necessary.
