Reminder - AGC Day at the Races, July 20
For those who have purchased tickets to the Annual AGC Day
at the Races in Del Mar on Friday July 20 please remember
that
the first post
(race) is at 4:00 p.m. Be sure to give
yourself plenty of time to get there, as traffic is usually
very congested.
Upon your arrival, go to the
Stretch Run Entrance –
“Blue”
Admission Gate and present the
admission ticket to the attendant
(detach
the badge and affix it to your lapel).
Your official Racing Programs will be distributed at the
admission gate. You may use the stairs or elevator at the
Grandstand entrance to reach the
sixth floor and
proceed to the
Star Fiddle
Skyroom. Attendees are required to wear
the Skyroom badges at all times.

Bad News from Washington: $16 Billion in Potential Cuts to
2009 Federal Highway Funding

California Could Lose $1.35 billion
Last week,
the Bush Administration released its mid-session budget
review, which updates the data included in the President's
budget released in February. The budget estimate released
in February forecasted a $700 million Highway Trust Fund (HTF)
shortfall in Fiscal Year (FY) 2009. The update increases the
forecasted shortfall to more than $4 billion dollars in FY
09.
AGC is
calling on the Bush administration and Congress to maintain
commitments to the current transportation bill.
Because of
the spending rate in the HTF, it will require Congress and
the President to find additional revenues to plug the $4
billion hole or cut highway funding for FY 09 by an
estimated $16 billion. The cuts in FY 2009 from the
promised level of $43.4 billion to about $27 billion would
result in a 37% reduction in spending on our nation's
infrastructure. That dramatic reduction in funding would
impact every state in the country because the highway
program is financed by gas tax revenues that are deposited
into the HTF. If the deficit is not patched, it is
estimated that California will lose $1.35 billion in 2009.
The
mid-session review also increased the forecast shortfall to
$9 billion in 2010 and to $15 billion in 2011. Those
amounts will also require significant reductions in spending
if Congress and the administration can not agree on methods
to plug the funding gap. Transit funding will also be
impacted long term, because it too is funded primarily by
the HTF.
The budget
news comes at a critical juncture for the highway program,
and federal, state and local governments will all feel the
pinch. AGC has been working with its allies in State
Transportation Departments on solutions to fix the problem
and has presented a menu of ideas to both the Bush
administration and Congress.

With the above news fresh on our minds, the quarterly
Liaison Committee meeting with Caltrans couldn’t be more
timely! We will hear from Caltrans and the San Diego
Association of Governments about how their projects could be
affected by the potential federal highway budget cuts. As
we reported to you last month, Caltrans believes it will be
paying
$20-30 million a month in progress payments in 2008/09.

A Run-off of Attendees Expected at August 2 Storm Water
Run-off Meeting!
Last week, we
informed AGC members and public agencies about an August 2
meeting to discuss new and potentially damaging storm water
regulations. Even though the rainy season begins in over
three months, over 80 attendees have already responded to
our offer…so we can expect a packed house!
Earlier this year, the San Diego Regional Water Quality
Control Board adopted a new General Municipal Storm Water
Permit (Municipal Permit) for San Diego County. The
Municipal Permit includes many new and untested requirements
that will have significant impacts on both local contractors
and public agencies. Meanwhile, the State Water Resources
Control Board has begun considering a Preliminary Draft
Construction Storm Water Permit, which will affect
contractors and public agencies statewide.
On Thursday, August 2 from 10:00 – 11:30 AM, AGC will host a
meeting to discuss the impacts of these two permits and hear
from experts about the strategies to address those impacts.
Contractors, engineers, architects, and public agency
representatives are encouraged to attend.

Some of the reasons to attend the August 2 meeting:

The Municipal Permit makes San
Diego County’s 18 cities, the County of San Diego, the
Airport, and the Port of San Diego responsible for
contaminated run-off entering their storm drains regardless
of the source.
Expect to see
agencies sue other agencies and expect to see the
responsibility fall to the general contractor, whose project
may be alleged to have caused the discharge.

The Municipal Permit imposes
significant new requirements, which will significantly
increase the costs of public and private work.
·
The Municipal Permit requires
jurisdictions to limit significantly the amount of land that
can be graded at any one time without significant additional
Best Management Practices and monitoring controls.
·
The Proposed State Construction
Permit exacerbates the land use and operational controls
already required in the Municipal Permit.
·
The Proposed State Construction
Permit proposes a strict limitation of the volume of post
construction run-off to be no more than 110% of the pre
construction condition.
These permits
will significantly impact land values, construction costs,
and corporate liabilities. However, by understanding these
new requirements both contractors and public agencies will
be able to manage the construction costs and legal
liabilities.
